DMCA & Intellectual Property Policy

搂 1Our policy

GPT Image 2 respects the intellectual-property rights of others and expects users of the Service to do the same. We respond to clear notices of alleged copyright infringement under the U.S. Digital Millennium Copyright Act ("DMCA"), the EU Copyright Directive, and equivalent laws elsewhere. We will remove infringing content and, in appropriate circumstances, terminate the accounts of repeat infringers.

搂 2Submitting an infringement notice

If you are a copyright owner or its authorised agent and you believe that content available through the Service infringes your copyright, please send a notice to [email protected] with the subject line DMCA Notice. To be effective under 17 U.S.C. 搂 512(c)(3), the notice must include:

1. A physical or electronic signature of a person authorised to act on behalf of the rights-holder.
2. Identification of the copyrighted work claimed to have been infringed (or, if multiple works, a representative list).
3. Identification of the material that is claimed to be infringing, with information reasonably sufficient to permit us to locate it (e.g. URLs, task IDs, screenshots).
4. Information reasonably sufficient to permit us to contact you (address, telephone number, email).
5. A statement that you have a good-faith belief that use of the material in the manner complained of is not authorised by the copyright owner, its agent, or the law.
6. A statement, under penalty of perjury, that the information in the notification is accurate, and that you are the copyright owner or authorised to act on its behalf.

搂 3Trademark complaints

If you believe that the Service is being used to infringe a trademark you own, send a notice to the same address with the subject line Trademark Complaint. Include: (a) your trademark registration number and jurisdiction, (b) the goods/services covered, (c) URLs or task IDs of the infringing material, and (d) your contact information.

搂 4Counter-notice

If you believe content was removed or disabled in error or as a result of misidentification, you may submit a counter-notice with the subject line DMCA Counter-Notice containing:

1. Your physical or electronic signature.
2. Identification of the material that has been removed or disabled and its location before removal.
3. A statement under penalty of perjury that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification.
4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal court in the district where you reside (or, if outside the U.S., the federal court for any judicial district in which we may be found), and that you will accept service of process from the person who provided the original notice or an agent of such person.

搂 5Repeat-infringer policy

We terminate, in appropriate circumstances, the accounts of users who are repeat infringers. We may also limit access to the Service or terminate accounts of any user, at our discretion, where the user is found to be infringing the IP rights of others, regardless of whether there is repeat infringement.

Under 17 U.S.C. 搂 512(f), any person who knowingly materially misrepresents that material is infringing, or that material was removed or disabled by mistake or misidentification, may be subject to liability. Please ensure your notice or counter-notice is accurate before sending.
