搂 1Acceptance of these terms

These Terms of Service ("Terms") form a binding contract between you ("you", "User") and GPT Image 2 ("we", "us", "our", or "GPT Image 2"), the operator of images2gpt.com. By creating an account, signing in, or otherwise using the website, the API, or any related service (the "Service"), you confirm that you have read, understood, and agreed to these Terms, our Privacy Policy, our Acceptable Use Policy, and our Refund Policy.

If you are using the Service on behalf of an organisation, you represent that you have authority to bind that organisation. You must be at least 18 years old, or the age of majority in your jurisdiction.

搂 2The Service

GPT Image 2 is a paid web application that lets users generate images from text prompts. We do not own or train the underlying generative model. We provide a custom interface, account management, credit accounting, content-safety filtering, and customer support on top of third-party model providers (currently kie.ai's GPT Image 2 endpoint).

We may change, add, or remove features at any time. We may also impose reasonable usage limits to protect Service stability.

搂 3Your account

To use most of the Service you must create an account using a valid email address and a password of at least 6 characters. You are responsible for: (a) keeping your credentials confidential, (b) all activity under your account, and (c) notifying us promptly at [email protected] if you suspect unauthorised access.

One free image generation is available without an account, tracked by IP address for abuse prevention. After that, an account is required.

搂 4Credits, plans & billing

4.1 Credits

Each generation deducts credits according to its resolution: 10 credits for 1K, 20 credits for 2K, 40 credits for 4K. New accounts receive 10 free credits on sign-up. We may change prices and credit costs prospectively (changes do not affect credits already in your balance).

Credits are non-refundable except as required by law or as expressly stated in our Refund Policy. Credits expire 12 months after they are added to your account if unused. Credits cannot be transferred between accounts.

4.2 Subscriptions

Paid plans (Basic, Pro, Max) are billed monthly or annually in advance via our Merchant of Record (Creem / Armitage Labs O脺). Subscriptions auto-renew until you cancel. You may cancel at any time from your account settings or via the Customer Portal; cancellation stops future renewals but does not entitle you to a pro-rated refund of the current period unless required by law.

4.3 Failed generations

If a generation fails for reasons attributable to us or to the upstream model provider (e.g. service downtime, model error), we will automatically refund the credits charged for that task. This refund is processed when our system detects the failure and is normally reflected in your balance within seconds.

4.4 Taxes

Prices shown are exclusive of taxes unless stated otherwise. Our Merchant of Record handles VAT, GST, and sales tax for your jurisdiction.

搂 5Acceptable use & prohibited content

Using the Service, you agree to comply with our Acceptable Use Policy, which is incorporated into these Terms by reference. In particular, you must not generate or attempt to generate:

• Sexually explicit or pornographic content; sexually suggestive content depicting any real or fictional minor; non-consensual intimate imagery.
• Realistic depictions of identifiable real people without their consent ("deepfakes"), or face-swap output.
• Content that promotes terrorism, hate, self-harm, or violence against a protected group.
• Content designed to defraud, deceive, or impersonate.
• Content that infringes intellectual-property rights, trademarks, or rights of publicity.
• Malware, phishing pages, or anything that violates applicable law.

We use automated and manual moderation to enforce these rules. We may refuse, modify, or remove generations, and we may suspend or terminate accounts at any time for violations.

搂 6AI wrapper disclosure

GPT Image 2 (images2gpt.com) is an independent product. We are not affiliated with, endorsed by, or sponsored by OpenAI, Microsoft, Google, or kie.ai. We provide a custom interface that connects to third-party generative-image models 鈥?currently the GPT Image 2 model offered by kie.ai. Model availability, latency, output quality, and content policies of the underlying model can change without our control.

搂 7Your content & generated outputs

7.1 Your inputs

You retain ownership of the prompts and reference images you submit ("Inputs"). You grant us a limited, worldwide, royalty-free licence to host, process, and transmit Inputs as necessary to operate the Service, comply with law, and enforce these Terms. We do not use your Inputs to train AI models.

7.2 Generated images

To the maximum extent permitted by law, we transfer to you all rights we have in the generated image ("Output") for both personal and commercial use, subject to your compliance with these Terms and applicable law. AI-generated outputs may not be eligible for copyright protection in some jurisdictions; you are responsible for confirming your rights before commercial use.

You are solely responsible for the legality of your Outputs. You agree not to use Outputs to defame, harass, or infringe the rights of any person.

搂 8Intellectual property

The Service, including the website, software, "GPT Image 2" branding, logos, and the underlying code, is protected by copyright, trademark, and other laws. We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Service in accordance with these Terms. Nothing in these Terms transfers ownership of our intellectual property to you.

搂 9Third-party services

The Service depends on third-party providers (Cloudflare, kie.ai, Creem). Their availability, terms, and policies may affect your experience. We are not responsible for the acts or omissions of third-party providers, except where required by law.

搂 10Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY OF GENERATED CONTENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT GENERATED IMAGES WILL MEET YOUR REQUIREMENTS.

搂 11Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL GPT IMAGE 2, ITS AFFILIATES, OR ITS LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

OUR TOTAL CUMULATIVE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE FEES YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) USD 100.

搂 12Indemnification

You will indemnify, defend, and hold harmless GPT Image 2 and its affiliates, officers, employees, and agents from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your Inputs or Outputs; (b) your breach of these Terms; or (c) your violation of any law or any rights of a third party.

搂 13Suspension & termination

We may suspend or terminate your account or access to the Service immediately, with or without notice, if (a) you violate these Terms or any policy, (b) we suspect fraudulent activity, (c) we are required to do so by law, or (d) the Service is discontinued. You may terminate by deleting your account at any time. On termination, your access ceases; sections that by their nature should survive (IP, disclaimers, liability, indemnity, governing law, miscellaneous) will survive.

We may modify these Terms from time to time. The "Last updated" date at the top reflects the most recent revision. For material changes we will provide reasonable advance notice (e.g. by email or in-product banner). Continued use after the effective date constitutes acceptance.

搂 15Governing law & disputes

These Terms are governed by the laws of Hong Kong SAR, without regard to conflict-of-laws principles. Subject to applicable mandatory consumer-protection laws of your country of residence, any dispute arising out of these Terms or the Service will be subject to the exclusive jurisdiction of the courts of Hong Kong. Nothing in this section limits any non-waivable rights you have under applicable consumer law.

搂 16Miscellaneous

• Entire agreement. These Terms, together with our Privacy Policy, Acceptable Use Policy, Refund Policy, Cookie Policy, and DMCA / IP Policy, constitute the entire agreement between you and us regarding the Service.
• Severability. If any provision is held unenforceable, the remaining provisions remain in effect.
• No waiver. Our failure to enforce a provision is not a waiver of our right to do so later.
• Assignment. You may not assign these Terms without our prior written consent. We may assign these Terms to an affiliate or in connection with a merger, acquisition, or sale of assets.
• Force majeure. We are not liable for failures caused by events beyond our reasonable control (network outages, model-provider downtime, natural disasters, government action, etc.).
• Notices. We may give notices by email or by posting in-product. You may give notices to [email protected].
